Why is Umbrella / Excess Liability insurance important?

Umbrella and/or Excess Liability insurance is essential for the average business owner because it provides an extra layer of protection beyond the limits of standard liability policies like general liability, auto liability, or employer’s liability. In today’s litigious environment, a single lawsuit or catastrophic event could exceed primary policy limits, putting a business’s assets—and future—at serious risk. Umbrella coverage helps ensure that the business can survive financially after large claims, such as severe injuries, major property damage, or reputational lawsuits. It also helps protect personal assets in closely held or sole proprietorship businesses where the owner's liability can extend beyond the company.

Moreover, umbrella insurance is relatively affordable compared to the high financial risks it covers, making it a cost-effective safeguard. It can also fulfill contract requirements when working with large clients or government entities that demand higher liability limits. Without it, a business could be forced to close or declare bankruptcy after a major claim. Claims Example:

A small contractor with a fleet of (15) work vehicles operated for years without serious incidents. The owner carried basic Commercial Auto ($1MM Limit) and General Liability insurance but chose not to purchase Umbrella Liability coverage, thinking it wasn’t necessary. One afternoon, an employee driving a company vehicle was involved in a tragic accident that resulted in a fatality and severe injuries to a child.

A lawsuit followed, and the court awarded over $3 million in damages to the victim’s family. The business’s auto policy covered $1 million, but the remaining $2+ million had to be paid out-of-pocket. Without Umbrella coverage, the owner was forced to sell equipment, lay off staff, and take out high-interest loans just to meet the financial judgment.

The accident—while unintentional—devastated the company’s finances and nearly shut it down. The owner later admitted the loss could have been absorbed if they had carried a relatively inexpensive Umbrella Liability policy. A single unexpected event had erased years of work, simply because the business lacked a safety net.
